MS SB2813

Creates three new statutory definitions: "female" as a member of the human species that produces eggs with a reproductive system oriented around egg production; "male" as a member that produces sperm with a reproductive system oriented around sperm production; and "sex" as biological indication based on sex chromosomes, hormones, gonads, and genitalia present at birth, excluding psychological or subjective gender experience.

Requires birth certificates to include the child's name, parents' names if known, birthplace, and sex identified as male or female.

Prohibits changing the sex designation on a birth certificate unless a mistake was made at the time the certificate was originally issued.

Amends existing birth certificate correction procedures in sections 41-57-21 and 41-57-23 to conform with the sex designation prohibition.

Takes effect July 1, 2024.
