House Bill 1083 Summary

• Amends Section 43-13-407 of the Mississippi Code to delete the repealer on provisions relating to the Health Care Expendable Fund, making those provisions permanent rather than subject to expiration.

• Establishes the Health Care Expendable Fund in the State Treasury with transfers from the Health Care Trust Fund in specified amounts from fiscal years 2005-2009 ($456 million in FY2005, declining to $92.25 million in FY2009).

• Requires the State Treasurer to deposit tobacco settlement installment payments into the Health Care Expendable Fund beginning in calendar year 2009, with full amounts deposited in most years except calendar year 2011 (which retains $10 million).

• Restricts use of Health Care Expendable Fund monies exclusively for health care purposes and prohibits unexpended funds from reverting to the State General Fund at fiscal year-end.

• Effective July 1, 2025.
