MS HB1339

Creates a nine-member Holly Springs Utility Department Board with five members appointed by the City of Holly Springs governing authority, two members appointed by the Marshall County Board of Supervisors, and two members appointed by the Benton County Board of Supervisors.

Board members serve four-year terms with staggered initial appointments ranging from one to four years; board members must be qualified electors from their respective appointing authorities and cannot hold other county or municipal office.

Board members manage and control the Holly Springs Utility Department system, facilities, and services both within and outside city limits, with compensation set by appointing authorities but equal across all board members.

Appointing authorities may require board members to post bonds for faithful performance of duties, with premiums paid from treasury or system funds; board members may be removed for cause by the appointing authority with ratification by a chancery judge.

Effective date is July 1, 2025.
