House Bill 401 Summary

• Creates new Section 25-43-3.100 requiring state agencies to identify and repeal at least two existing rules whenever adopting a new rule, effective simultaneously with the new rule.

• Amends rule-making procedures to require agencies to list the two or more rules targeted for repeal in their public docket, notice of proposed rule adoption, and official rule-making record.

• Requires agencies to include in economic impact statements an estimate of cost offsets achieved by eliminating the identified rules being repealed.

• Applies to all new rule adoptions unless otherwise prohibited by law, with amendments conforming related sections of Mississippi Administrative Procedures Law to these requirements.

• Effective date: July 1, 2025.
