Employer or insurer is not required to intervene in lawsuits against third parties responsible for employee injury or death, but forfeits subrogation rights to recover compensation paid if they fail to join the action.

Subrogation liens are reduced by the percentage of fault attributable to the employer if the employer is found negligent in the injury or death case.

Amends Section 85-5-7 to clarify that subrogation liens for immune employers are reduced by the percentage of the employer's negligence as provided in the workers' compensation statute.

Effective date is July 1, 2025.
