HB 853 Summary

• Amends Section 31-7-13 of Mississippi Code to require prequalification of bidders for construction, maintenance, repair, and renovation projects with a minimum cost of $10,000,000.00 or more.

• Establishes that prequalification solicitations must comply with standard bidding procedures outlined in paragraph (c) and be determined at least 15 working days before prequalified bidders are invited to submit bids.

• Limits prequalification criteria to bidders' and proposed subcontractors' knowledge and experience on similar projects, past performance, project management team composition, and financial stability.

• Applies prequalification requirement to historical buildings designated as Mississippi Landmarks by the Board of Trustees of the Department of Archives and History, as well as other major construction projects meeting the $10,000,000 threshold when agencies determine prequalification is in the state's best interest.

• Takes effect July 1, 2025.
