MS SB2202

Creates two crimes for unlawful dissemination or publication of digitally created or altered intimate images/audio and non-intimate images/audio depicting identifiable persons without consent, with intent to cause emotional, financial, or physical harm.

Intimate image/audio offense: felony for offenders age 21+ (same penalty as photographing without permission expectation of privacy), misdemeanor for offenders under 21 (up to $2,500 fine or 1 year imprisonment); second or subsequent offense is felony with doubled penalties.

Non-intimate image/audio offense: misdemeanor punishable by up to $2,500 fine or 1 year imprisonment.

Defines "digitization" as altering images or audio in realistic manner using unrelated person's likeness or computer-generated means, including artificial intelligence and machine learning.

Exempts law enforcement, legal proceedings, medical treatment, voluntary public exposure, legitimate public purpose dissemination, and internet service providers providing neutral access; effective July 1, 2025.
