Establishes a one-year time limitation for tolling the statute of limitations under the intervening decision and newly discovered evidence exceptions in post-conviction relief proceedings.

Prohibits ineffectiveness or incompetence of counsel during state collateral post-conviction proceedings from being grounds for relief or exceptions for relief in proceedings under the Mississippi Uniform Post-Conviction Collateral Relief Act.

Applies the one-year tolling period from either the date a mandate was issued in an intervening decision or the date facts supporting a newly discovered evidence claim could have been discovered through due diligence.

Amends Sections 99-39-27 and 99-39-23 to conform with the new provisions regarding tolling periods and counsel ineffectiveness standards.

Takes effect July 1, 2025.
