Revises penalties for first and second simple possession offenses of controlled substances (other than 30 grams or less of marijuana or 10 grams or less of synthetic cannabinoids) to misdemeanors: first offense up to 6 months imprisonment or $100 fine; second offense up to 1 year imprisonment or $200 fine.

Increases threshold for repeat offender penalties under Section 41-29-147 from second offense to fourth or subsequent offense for simple possession convictions.

Establishes enhanced penalties for third or subsequent simple possession offenses of Schedule I/II drugs, marijuana, synthetic cannabinoids, and Schedules III/IV/V drugs, with sentence lengths and fines varying by substance type and quantity.

Allows judges to suspend penalties for simple possession convictions and to reduce mandatory trafficking sentences by up to 75% under specific circumstances (offender not a leader, no violence/weapons used, no death/serious injury).

Effective date: July 1, 2025.
