Simple possession of 30 grams or less of marijuana is reclassified as a civil infraction punishable by a civil fine of $100, rather than criminal charges.

A person operating a motor vehicle who possesses more than 1 gram but not more than 30 grams of marijuana in the passenger area commits a civil infraction punishable by a $100 fine.

Second conviction for possession of 30 grams or less within 2 years becomes a misdemeanor punishable by a $250 fine, up to 60 days in county jail, and mandatory drug education program.

Third or subsequent conviction within 2 years is a misdemeanor punishable by $250-$1,000 fine and up to 6 months in county jail.

Municipal courts are granted jurisdiction to hear civil infraction cases and impose civil penalties as prescribed by law.
