Law enforcement officers who test positive for illegal drugs on a urinalysis must be given the opportunity to take a more scientifically reliable follow-up test before termination or suspension without pay.

Officers testing positive may be placed on administrative leave with pay and have two business days after written notice to contest the urinalysis results.

Officers who contest results within the two-day period have an additional five days to voluntarily submit a hair follicle sample at a certified laboratory for drug analysis.

If the hair follicle test is negative for the drug(s) in the urinalysis, the urinalysis is declared a false positive and the officer is immediately reinstated to their previous position.

The officer initially pays for the hair follicle test, but if the result is negative, the employer reimburses the cost; if positive, the officer bears the cost.
