Amends Section 11-7-13 to authorize recovery of expenses or damages incurred by the deceased prior to death, including personal injury damages during the deceased's lifetime in wrongful death actions.

Allows damages to be distributed regardless of whether the legal representative of the decedent's estate is a party to the action, enabling claims to be brought outside an estate.

Clarifies that all other damages recovered (beyond property damage, funeral, and medical expenses) are not subject to payment of the deceased's debts or liabilities, except as provided in the statute.

Requires defendants to request determination of heirs within 90 days of filing an answer, with such determination to be resolved before trial commencement.

Takes effect July 1, 2025.
