Department of Mental Health shall develop and promulgate a rating scale with performance standards for auditing community mental health centers, with standards to be completed by June 30, 2026.

Department shall conduct performance audits of each community mental health center at least once every two years, beginning in fiscal year 2027.

Community mental health centers failing a performance audit receive a six-month probationary period; if they fail to achieve a passing score after probation, the regional commission must replace the executive director and identified officers with contractors selected and supervised by the department.

Contractors remain in place until the department determines the center has achieved sustained compliance with performance standards, followed by a six-month period to demonstrate continued compliance.

Personal and professional services contracts entered into by the Department of Mental Health for these audit and contractor responsibilities are exempted from Public Procurement Review Board approval.
