Board of supervisors may maintain and regulate all public cemeteries owned or controlled by the county or any municipality within county limits, with authority to enlarge cemeteries.

Board of supervisors may maintain and repair abandoned public or private nonprofit cemeteries (community, religious, or fraternal) within county boundaries using available county funds, excluding family burial grounds and for-profit perpetual care cemeteries.

Board of supervisors may acquire title to improperly maintained cemeteries by gift, purchase, eminent domain, or other means if determined to be in the best interest of the county or municipality and detrimental to public health and welfare.

Board of supervisors may repair and maintain cemeteries designated as historically significant upon certification by the state department of archives and history, with adjoining counties authorized to jointly maintain cemeteries spanning their former borders.

Act takes effect July 1, 2025.
