Employers or insurers who fail to join lawsuits against third parties responsible for employee injury or death forfeit their right to repayment of compensation and medical expenses from any recovery

Employer subrogation liens must be reduced proportionally by the percentage of fault attributed to the employer when the employer is found negligent in the injury

Amends Mississippi's allocation of fault statute (Section 85-5-7) to specify that subrogation liens shall be reduced by an immune employer's percentage of negligence

Maintains employees' rights to sue third parties for workplace injuries while preserving employers' option to join such actions
