Retired Public Employees' Retirement System (PERS) members elected to the Mississippi Legislature may continue receiving their retirement allowance while serving, provided they retired at least 90 consecutive days before beginning legislative service

Legislators receiving retirement while serving must choose between two compensation options: 50% of regular session compensation while working no more than half the normal working days per fiscal year, or up to 25% of their average compensation with no limit on working days

Persons receiving retirement benefits while serving as legislators cannot be active members of PERS or the Supplemental Legislative Retirement Plan and will not earn additional creditable service during that period

Legislators who choose not to receive retirement benefits while serving remain active contributing members and will have their retirement allowance recomputed upon subsequent retirement if they serve more than six months

The bill takes effect July 1, 2026, and amends multiple sections of the Mississippi Code including provisions for PERS membership eligibility and legislative compensation
