Possession of less than 3.5 ounces of marijuana would be subject to a $100 civil penalty rather than criminal charges under this amendment to Mississippi Code Section 41-29-139

The bill modifies the existing penalty structure for marijuana transfer offenses, creating a new tier for amounts between 30 grams and 3.5 ounces that carries up to 3 years imprisonment and $3,000 fine

Current law already treats possession of 30 grams or less of marijuana as a fine-only offense ($100-$250), but this bill extends decriminalization to the larger 3.5-ounce threshold

The changes do not affect penalties for synthetic cannabinoids, other controlled substances, or marijuana amounts exceeding 3.5 ounces

Effective date is July 1, 2026
