First-time offenders who complete all terms and conditions of their sentence will automatically receive a court order expunging their conviction from all public records, with fees waived and legal services provided pro bono

A nonpublic record of expunged convictions will be retained solely to determine first-offender status in future proceedings

The waiting period for felony expunction petitions is reduced from 5 years to 2 years after successful completion of sentence terms

Certain felonies remain ineligible for expunction, including crimes of violence, first-degree arson, drug trafficking, sex offender registration violations, witness intimidation, and embezzlement

The law takes effect July 1, 2026, and applies to controlled substances convictions under Section 41-29-139 as well as general criminal convictions under existing expunction statutes
