MS SB2114

Creates a state felony for aliens entering Mississippi directly from a foreign nation at any location other than a lawful port of entry, punishable by at least 2 years imprisonment

Adds a separate felony charge (minimum 2 years, up to 5 years for violent or sex offenses) for illegal aliens arrested for crimes punishable by 3+ months imprisonment, in addition to penalties for the underlying offense

Requires the Department of Public Safety to execute a 287(g) agreement with ICE within 120 days, and requires all county detention facilities to enter similar agreements by October 1, 2026

Allows courts to discharge defendants (except those charged with violent or sex crimes) in lieu of prosecution if they agree to return to their country of origin and pay a $35,000 fine

Defendants convicted under this act are ineligible for expunction, parole, nonadjudication, or any early release program
