CDL holders who commit a first-offense DUI while operating a non-commercial vehicle would become eligible for nonadjudication under this amendment to Mississippi Code Section 63-11-30

Current law bars all commercial driver's license and commercial learning permit holders from nonadjudication for any first-offense DUI regardless of vehicle type

CDL holders would also become eligible for expunction of a first-offense DUI conviction if they were not operating a vehicle requiring a commercial license at the time of the offense

The bill maintains all existing DUI penalties, including fines of $250-$1,000 and up to 48 hours jail time for first offenses, with escalating penalties for subsequent violations

Effective date is July 1, 2026
