Department of Mental Health must develop and promulgate a rating scale with performance standards for Community Mental Health Centers by June 30, 2027, and begin conducting performance audits during fiscal year 2028.

Each Community Mental Health Center must undergo a performance audit at least once every two years to assess compliance with established standards.

Centers that fail to achieve a passing score receive a six-month probationary period; if still failing after probation, the department will replace the executive director and identified officers with department-selected contractors.

Community Mental Health Centers found in noncompliance have due process rights, including the ability to appeal replacement decisions to the State Board of Mental Health within 14 days, with a hearing conducted within 90 days.

The bill repeals Sections 41-20-1 through 41-20-11, which created the Coordinator of Mental Health Accessibility position within the Department of Finance and Administration, and exempts related DMH contracts from Public Procurement Review Board approval.
