When an incumbent county attorney runs unopposed, the general election ballot must use a retention question format: "Shall [name], the county attorney of [county], be retained in office for another term?"

Election administrators are prohibited from including nonpartisan designations or write-in spaces for unopposed incumbent county attorneys on the general election ballot.

Voters must be given the option to vote "yes" or "no" on retaining the incumbent, following rules established under Montana Code 13-12-202.

The new provisions would be codified in Title 7, chapter 4, part 27 of Montana law, which governs county attorney elections.
