Montana may initiate criminal prosecution against individuals who are subject to federal immigration detention for any state crimes committed in Montana

When state charges are pending, Montana may either surrender the person to federal authorities on demand for immigration violations or hold them until the state case is resolved through trial, discharge, conviction, or punishment

Prosecutors must notify the Montana Attorney General before declining to prosecute a person subject to federal immigration detention, giving the Attorney General opportunity to initiate prosecution instead

New provisions will be codified in Title 46, chapter 1, part 1 of Montana Code (criminal procedure)
