Prohibits courts from placing sentenced defendants with mental disease, disorder, or developmental disability at the state forensic mental health facility at Galen

Defendants found to have mental conditions at the time of their offense may still be placed in other appropriate facilities, including correctional facilities, other mental health facilities, residential facilities, or developmental disabilities facilities

Amends Section 46-14-312, MCA, which governs sentencing of defendants with mental health conditions

Does not affect rights, duties, penalties, or proceedings that began before the effective date

Effective immediately upon passage and approval
