Homeowners' associations must obtain permission from property owners before an HOA agent can enter their property, including establishing a mutually convenient date/time and specifying which part of the property will be accessed.

Property owners may require that they or their designated agent be present during any HOA entry onto their property.

The permission requirement does not apply to areas generally open to the public, such as sidewalks, front pathways, or approaching a front door.

Condominiums with common elements requiring unit access (where declaration of covenants or bylaws already address access terms) and recorded easements benefiting the HOA are exempt from these requirements.
