Any party in a proceeding challenging the constitutionality or legality of a legislative act may demand a jury trial to determine disputed factual issues

Any party challenging a proposed or adopted ballot issue (as defined in 13-1-101) is entitled to a jury trial on disputed factual questions

Amends Section 27-8-302, MCA, governing jury trials in declaratory judgment proceedings to add these jury trial rights

Effective immediately upon passage and approval

Applies to proceedings where a party demands a jury trial on or after the effective date
