Accepted bids in residential home construction contracts constitute the full financial obligation and cannot be increased after acceptance

Time and materials contracts (where clients pay based on actual material costs and hourly labor rates) require written agreement from both parties

Exceptions allow bid increases when parties agree in writing prior to bid acceptance that the bid is not final

Additional exceptions apply for agreed-upon changes in scope of work, materials costs, or subcontractor bids

Provisions would be codified under Montana Code Title 28, chapter 2 (contract law)
