Manufacturers, marketers, dealers, distributors, retailers, and sellers of pesticides have a duty to warn consumers, applicators, and the public about pesticide risks

A pesticide supply chain entity satisfies its duty to warn under all liability theories if the pesticide bears an EPA-approved label under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and is registered with both the EPA and Montana Department of Agriculture

No liability or cause of action may arise for failure to warn about pesticide risks if the entity complies with federal EPA labeling and state registration requirements

Applies only to causes of action arising on or after the effective date of the act
