Public and nonpublic schools may maintain stock albuterol (quick-relief asthma medication) for emergency administration by school nurses or authorized personnel to students or nonstudents experiencing respiratory distress

Stock albuterol must be prescribed by a physician, advanced practice registered nurse, or physician assistant with the school designated as the patient, and filled by a licensed pharmacy

Authorized personnel must complete annual asthma education training approved by the Department of Public Health and Human Services covering respiratory distress recognition, albuterol administration techniques, and emergency response protocols

Schools are protected from liability for injuries arising from stock albuterol administration unless resulting from gross negligence, willful misconduct, or intentional tort

Schools must report each use of stock albuterol to the Department of Public Health and Human Services within 3 days and submit annual summary reports; effective July 1, 2025
