Amends Montana's "best interest of the child" statute (40-4-212, MCA) to add a parent's position on a child's gender transition as a factor courts must consider in custody and parenting plan determinations

A parent who knowingly encourages or actively supports a child's gender transition must be considered as acting against the child's best interests, with such support afforded "similar consideration as an act of physical abuse against the child"

A parent who opposes a child's gender transition may not have that opposition counted against them in best interest determinations

Effective immediately upon passage and approval
