Creates a voluntary do-not-sell list allowing Montana residents to add themselves to the National Instant Criminal Background Check System (NICS), temporarily waiving their firearm rights as a suicide prevention measure

Local law enforcement must add individuals to the list within 24 hours of receiving a signed waiver form; removal requires a 21-day waiting period, or expedited removal through district court within 2 business days with no filing fees

Voluntary waiver forms must be available at Department of Public Health and Human Services and Department of Justice websites, court clerk offices, licensed medical professional offices, and local law enforcement agencies

Penalties include perjury charges for false statements, up to $25 fine or 4 hours community service for possessing a firearm while on the list, and up to $1,000 fine and/or 1 year incarceration for coercing someone to sign waiver documents

Effective January 1, 2026; records are confidential and entities are prohibited from discriminating against individuals based on their voluntary waiver status
