Prohibits enforcement of covenants, conditions, or restrictions against residential property owners that impose more onerous restrictions than those existing when the owner acquired the property, unless the owner expressly agrees in writing

Requires owners claiming an exception to record it with the county clerk and recorder, pay recording fees, and notify other owners subject to the covenant

Successors-in-interest cannot claim the same protections as previous owners unless they share ownership, are family members inheriting the property, or are lenders who acquired through foreclosure

Exempts restrictions required to comply with federal, state, or local laws, ordinances, or regulations

Expands existing HOA restrictions in Section 70-17-901 to apply broadly to any person enforcing residential covenants, effective immediately upon passage
