Professional and occupational licensing boards (defined in 37-1-302) and license programs (defined in 37-1-401) may now request health care information through administrative subpoenas for investigative and disciplinary proceedings

Amends two Montana Code Annotated sections (50-16-535 and 50-16-811) governing when health care providers can disclose patient information through compulsory legal process

Adds a new exception to patient health care information confidentiality protections, allowing disclosure without patient authorization when licensing boards issue administrative subpoenas

Existing protections remain in place prohibiting disclosure where otherwise barred by law, and health information obtained in law enforcement proceedings against providers generally cannot be used against patients
