Department of Administration will oversee construction and operation of a secure forensic facility in eastern Montana for individuals adjudicated guilty but mentally ill, not guilty by reason of mental illness, or needing forensic evaluations or competency restoration

Facility must house at least 70 patients and provide secure housing, onsite psychiatric and medical treatment, competency restoration programs, rehabilitation services, and capability for court-ordered involuntary medication administration

Appropriates $60 million from the Behavioral Health System for Future Generations Fund for planning, designing, constructing, and equipping the facility for the biennium beginning July 1, 2025

Amends Section 50-1-119, MCA to allow the Behavioral Health System for Future Generations Fund to support construction of new property for behavioral health settings and immediate care facilities

Act becomes void if House Bill No. 5 passes with funding for a facility performing the same functions; effective date is July 1, 2025
