Adds Section 8 to Article XIII of the Montana Constitution establishing that no state constitutional right exists to possess, distribute, or receive child pornography or other obscene/nonmailable material as defined by federal law

Grants the state and all local governments (counties, cities, towns) explicit authority to outlaw and punish possession, distribution, or receipt of child pornography and obscene material, regardless of other constitutional provisions

Creates a private right of action allowing any person to sue individuals or entities that possess, distribute, or receive child pornography or obscene material, or that knowingly aid or abet such activities

Prevailing plaintiffs in private lawsuits are entitled to injunctive relief and reasonable attorney fees

Requires two-thirds legislative vote for passage and submission to voters at the November 2026 general election; effective upon voter approval
