Wind turbine generators 500 feet or taller must be set back at least 1,500 feet from occupied residences, unless the property owner approves a shorter distance.

Wind turbines in areas with ice class ratings of 4 or higher (per February 2017 International Energy Agency guidelines) must use commercially reasonable efforts to mitigate icing risks during deicing operations if located within 1,500 feet of an occupied residence.

Property owners can waive or modify setback and deicing requirements by providing approval.

The act takes effect January 1, 2026.
