Defines "actual physical control" for DUI purposes as operating or driving a motor vehicle on public roads and highways in Montana

Excludes from "actual physical control" situations where a person is seated in any seat except the driver's seat and the engine is running but the vehicle is not in a gear allowing self-propulsion

Excludes from "actual physical control" situations where a person is in a non-driver seat of a disabled vehicle incapable of self-propelled movement, unless the vehicle was disabled by a collision while the person was driving

Excludes from "actual physical control" situations where a person is propelling a disabled motor vehicle by means other than the engine (such as pushing)

Amends Section 61-8-1001, MCA by adding this new definition while renumbering existing DUI-related definitions
