All matters under investigation by the Office of the Child and Family Ombudsman must be treated as confidential, with information prohibited from disclosure except as specifically provided by law

Ombudsman records may be disclosed to a court for in camera (private) inspection if relevant to an issue before the court

Courts may permit disclosure in proceedings only if the court finds it necessary for fair resolution of an issue

The identity of any person who contacts or files a request for assistance from the ombudsman remains confidential, with limited exceptions under statute 41-3-1214

Provisions will be codified as part of Title 41, chapter 3, part 12 of Montana Code
