Removes the prohibition that prevented Montana postsecondary institutions and athletic associations from directly compensating student-athletes for use of their name, image, or likeness (NIL)

Maintains existing student-athlete rights to earn NIL compensation from third parties and to hire athlete agents for professional representation

Requires student-athletes to disclose NIL contracts to their institution and prohibits contracts that conflict with team rules or institutional third-party agreements (except when not engaged in official team activities)

Allows postsecondary schools to include NIL provisions in scholarship agreements, prohibit NIL use on school property, and serve as agents for athlete NIL contracts

Effective immediately upon passage and approval
