Manufacturers of publicly distributed online media in Montana using AI systems to direct, control, or focus information shown to individuals must disclose the AI use and provide users an opt-out option

AI-generated online media must contain identifiable markers (such as watermarks, labels, symbols, or disclaimers) alerting users to AI involvement, plus embedded markers that persist even if visible markers are deleted

Government entities are exempt from these disclosure and marker requirements

"Artificial intelligence" is defined as computer systems or algorithms that imitate human behavior and control information flow by generating written or verbal material
