H1377 - Safe Schools Act

• Requires superintendents to report to the State Board of Education when a career employee recommended for dismissal resigns without the superintendent's written agreement.

• Allows the written dismissal notice and the fact of reporting to the State Board of Education to be placed in the employee's personnel file and released to prospective employers upon request, without requiring employee consent.

• Deems resigning career employees to have voluntarily surrendered their teaching certificate pending State Board investigation for up to 45 days from the resignation date, with the Board required to complete investigation and make final decisions within 45 days.

• Maintains existing requirement that teachers not recommended for dismissal provide at least 30 days' notice before resigning, with boards able to request certificate revocation for the remainder of the school year if insufficient notice is given.

• Effective upon enactment on July 30, 2010, applying to career employees who resign on or after that date.
