Disapproves rule 23 NCAC 02C .0301 (Admission to Colleges) adopted by the State Board of Community Colleges on March 19, 2010, and approved by the Rules Review Commission on April 15, 2010.

Amends G.S. 115D-1 to require that community college students be "lawfully present in the United States" as a condition of admission.

Adds new subsection (u) to G.S. 115D-5 requiring that State Board of Community Colleges and all local community colleges prohibit admission of persons not lawfully present in the United States, except as required by federal law.

Requires that admissions standards without explicit language regarding unlawful presence be interpreted to comply with the lawful presence requirement.

Becomes effective upon enactment.
