Modifies G.S. 113-182.1(b) to establish separate timelines for fishery management plans: ending overfishing within 2 years and achieving sustainable harvest within 10 years from plan adoption.

Requires fishery management plans to include a standard of at least 50% probability of achieving sustainable harvest for the fishery.

Allows the Fisheries Director to waive timeline and probability requirements if the biology of the fish, environmental conditions, or lack of sufficient data make implementation incompatible with professional fisheries management standards.

Applies only to fisheries that are not producing a sustainable harvest and removes the prior 10-year combined timeline for ending overfishing and achieving sustainable harvest.

Effective upon becoming law; ratified June 17, 2010.
