Amends G.S. 136-18(39) to restrict the Department of Transportation from incurring any indebtedness, contract indebtedness, or capital lease obligations through partnership agreements except to the extent authorized by law other than this subdivision.

Requires partnership agreements to set forth the manner of funding costs for planning, designing, developing, acquiring, constructing, equipping, maintaining, and operating transportation infrastructure, with funding methods limited to those authorized by law.

Clarifies that partnership agreements may be entered into with the North Carolina Turnpike Authority, private entities, and authorized political subdivisions, and require Board of Transportation approval.

Requires the Department to report proposed partnership agreements to legislative committee chairs at the same time it notifies the Board of Transportation.

Effective July 1, 2010, and applies to partnership agreements entered into on or after that date.
