Establishes a building height limit of 35 feet in the Town of Oak Island south of the Atlantic Intracoastal Waterway, with a maximum of 41 feet in National Flood Insurance Program Velocity Zones.

Requires any increase or clarification of building height limits to be approved by referendum with dual-majority voting: a majority of qualified voters in the area south of the Atlantic Intracoastal Waterway AND a majority of qualified voters in the remainder of the town's corporate limits.

Permits only the town's governing body to call such referenda and specifies the ballot language for propositions to approve ordinances.

Supersedes and consolidates all prior local acts relating to height limits and local referenda for the former towns of Yaupon Beach and Long Beach.

Does not apply to corporate limits north of the Atlantic Intracoastal Waterway, where building height limits are established under general law.
