H.B. 726 Summary

• Replace local law enforcement affidavits with state and national criminal record checks conducted by the Department of Justice for expunction petitions under G.S. 15A-145, 15A-145.1, and 15A-145.2.

• Consolidate notification procedures for expunged records by requiring clerks to notify state and local agencies through a single process under G.S. 15A-150, replacing separate SBI and FBI submission requirements.

• Establish confidential files at the Administrative Office of the Courts and participating state agencies to track expunctions and verify notifications to private entities holding criminal history databases.

• Require private entities holding expunged criminal records to delete them within 10 business days of notification (or per licensing agreement terms) and impose civil liability for dissemination of expunged records.

• Effective October 1, 2010, with application to expunction petitions filed on or after that date.
