Division of Aging and Adult Services, Department of Health and Human Services, shall study criminal history record checks for owners, operators, volunteers, and prospective owners and operators in adult day care and adult day health services programs.

Study shall incorporate the current process used for adult day care employee criminal history record checks and seek input from the North Carolina Adult Day Services Association.

Study must address seven specific elements: positions warranting checks, check process development, responsible entities for requesting and paying for checks, scope of checks (state, national, or both), relevant criminal offenses indicating unfitness, and other appropriate issues.

Department of Health and Human Services shall report findings and recommendations to the North Carolina Study Commission on Aging by November 1, 2010.

Act is effective upon becoming law.
