Prohibits operating a motor vehicle on public streets, highways, or public vehicular areas while using a handheld mobile phone when the vehicle is in motion, effective December 1, 2010.

Creates exceptions for hands-free mobile phones, emergency communications with police/fire/ambulance/hospitals, and official use by law enforcement, fire departments, and ambulance operators.

Establishes violation as an infraction punishable by $100 fine plus court costs, with no driver's license points or insurance surcharges assessed.

Specifies that violation does not constitute negligence per se or contributory negligence in civil actions related to motor vehicle operation.

Appropriates $10,000 to the Department of Transportation, Division of Motor Vehicles for implementation, effective July 1, 2010.
