Authorizes Brevard Academy, a charter school in Brevard, North Carolina, to elect participation in the Teachers and State Employees Retirement System under Article 1 of Chapter 135 of the General Statutes.

Authorizes Brevard Academy to elect participation in the State Health Plan for Teachers and State Employees under Article 3A of Chapter 135 of the General Statutes.

Elections must be made no later than 30 days after the effective date of the act and must comply with all requirements of G.S. 135-5.3 and G.S. 135-45.5.

Waives time limitations otherwise contained in G.S. 135-5.3 and G.S. 135-45.5 that would restrict the charter school's ability to make these elections.

Effective upon becoming law, ratified July 9, 2010, and approved July 21, 2010.
