Disapproves 23 NCAC 02C .0301 (Admission to Colleges) rule adopted by the State Board of Community Colleges on March 19, 2010 and approved by the Rules Review Commission on April 15, 2010.

Amends G.S. 115D-1 to require that community college students be "lawfully present in the United States" as part of the major purpose of institutions operating under the community colleges system.

Adds new subsection (u) to G.S. 115D-5 requiring both the State Board of Community Colleges and all local community colleges to prohibit admission of persons not lawfully present in the United States, except as required by federal law.

Requires that admissions standards without explicit language regarding unlawfully present persons be interpreted to comply with the lawful presence requirement.

Effective upon becoming law.
